TERMS FOR USE ON THE LUXURY EYE WEBSITE

"USER AGREEMENT"

This User Agreement describes the terms and conditions applicable to Your use of this Site provided by Luxury Eye Limited. If You do not agree to be bound by this User Agreement, you may not use or access Our Services. You must read, agree with and accept all of the terms and conditions contained in this User Agreement before You may become a User of the Site. This User Agreement is effective on 1st December 2005 for new and existing registered Users.

1 DEFINITIONS
1.1 "Dealer" means the seller of goods advertising on the Site.
1.2 "Luxury" means a good of a certain quality based upon the sole discretion of Luxury Eye.
1.3 "Luxury Eye" means Luxury Eye Limited (Company Number 5196675) of 58 Davies Street, Mayfair, London, W1K 5JF. (“We” or “Us” or “Our”).
1.4 "Services" means the provision of services provided by Luxury Eye on Our website found at luxuryeye.co.uk and luxuryeye.com.
1.5 "Site" means the Luxury Eye websites at www.luxuryeye.com and www.luxuryeye.co.uk.
1.6 "User" means the private individual who contracts to use, enquire or purchase through the Site, (“You” or “Your”).
1.7 “User Agreement” means this document and its terms and conditions herein (“Agreement”).

2 ORDER PROCESS
2.1 Luxury Eye acts as agent in the sale of goods advertised for sale on the Site.
2.2 This Site acts as a venue that allows registered Users to buy Luxury goods and services. Luxury Eye is not responsible for the truth or accuracy of the listings, the ability of Dealers to sell items or the ability of Users to pay for items. Do not assume that the offer, sale, purchase, export or import of any item is valid and legal simply because it is listed on the Site. You accept sole responsibility for the legality of your actions under laws applying to you.
2.3 You will have an opportunity to check and correct any input errors in your order up until you click the ‘Process Order’ button.
2.4 After You submit an order We will send the purchase and delivery details to You in an e-mail. Please note that any e-mails We send are acknowledgements, not acceptance of your order.
2.5 We will tell You if Your payment details cannot be authorised for any reason and may invite You to pay by another method.
2.6 All funds must be cleared before any goods are dispatched/ collected.

3 RETURNS & REFUNDS POLICY
3.1 If for any reason you are not satisfied with your items purchased you may cancel your order and return the goods to Luxury Eye within 7 working days from receipt of the goods. You will receive a refund within 30 days of cancellation. At the sole discretion of Luxury Eye, we will accept the return of undamaged items that have not been specially ordered, worn, sized or otherwise used subject to the following limitations:

• For a full refund (less shipping, handling and up to 10% re-stocking charges) the items must be returned or exchanged within 7 days of purchase, accompanied by proof of purchase. All refunds will be in the original form of payment
• Before returning any item, please contact our Customer Service Team by calling +44 (0) 20 7499 8878 or email us at info@luxuryeye.co.uk to advise a return shipping date.
• Items are visually inspected upon receipt for signs of wear, prior to the issue of any refunds, exchanges or credits at the sole discretion of Luxury Eye.

3.2 Where You wish to return any goods, you will be asked to send a covering letter with the return detailing Your name, full address, order number and reason for return (please also specify whether You require an exchange or refund). We recommend that You use Special Delivery, as proof of shipping is not proof of receipt. Luxury Eye is not responsible for any item that it does not actually receive or that is not returned in accordance with these terms. 4 WARRANTIES
4.1 Luxury Eye undertakes every reasonable effort to ensure the Services are available without major interruption and as described in this Agreement. However, Luxury Eye does not warrant continuous, uninterrupted or secure access to the Site or the Services, and operation of the Site may be interfered with by external factors outside of our control.
4.2 To the extent permitted by law, the Services are provided "as is" and "as available". Therefore, Luxury Eye disclaims all other warranties with respect to the Services, either express or implied, to any implied warranties of satisfactory quality or fitness for any particular purpose.
4.3 Luxury Eye has used all reasonable efforts to check for viruses prior to publishing information and images on the Site, however, Luxury Eye does not warrant that the Site shall be free from all known viruses.
4.4 Luxury Eye does not accept liability for any inaccuracies, errors or omissions for item descriptions, pictures, information and prices.
4.5 Luxury Eye shall not be liable for any loss or damage arising from the unavailability of the Site or the Services. 4.6 Luxury Eye makes every effort to display as accurately as possible the colours of the images on this Site. However, as actual colours seen depend upon each computer monitor, Luxury Eye does not guarantee that the display of any colour will be accurate.

5 PAYMENT METHODS AND SHIPPING POLICY
5.1 1 All prices are GBP (Pounds Sterling) and credit / debit card transactions for orders outside the UK will be converted by the card company at their current exchange rates. Prices other than those in GBP are shown for guidance purposes only.
5.2 No contract exists between You and Luxury Eye for the purchase of any item unless and until We accept the order by taking payment for the goods. Orders are accepted at Our sole discretion.
5.3 All funds must be cleared before any goods are dispatched/ collected.
5.4 The shipping costs for each item may vary and are shown depending on the shipping destination and the delivery service selected. Any delivery times quoted are estimates.
5.5 Value Added Tax (VAT) depends on shipping destination. It is included in the price for orders shipped to destinations within the European Union (EU). For orders shipped outside the EU the price excludes VAT but orders may be subject to local sales tax or import duty. These are not included in Our prices and Users are liable for all taxes or duties on or following delivery for orders shipped in and outside the EU.

6 COPYRIGHT, PATENTS, TRADE MARKS AND OTHER INTELLECTUAL PROPERTY RIGHTS
6.1 The User acknowledges all copyrights, trademarks, trade names, patents and other intellectual property rights on or in connection with this Site shall be, and remain, the property of Luxury Eye.
6.2 The User acknowledges that the Luxury Eye name and any logos are trademarks of Luxury Eye and shall not be used except with the express written consent of Luxury Eye, who reserves the right to charge for the use of the same.
6.3 The User shall not register as a trade mark, domain name or company name any name or mark which is the same or confusingly similar to the Luxury Eye name and logo, anywhere in the world
6.4 The User shall indemnify Luxury Eye fully against all liabilities, costs and expenses that Luxury Eye may incur as a result of infringement of any copyright, patent or other proprietary right.

7 PRIVACY AND GOVERNING LAW
7.1 The User agrees to be bound by the terms of our Privacy Policy. This Agreement shall be governed by and construed in all respects in accordance with the laws of England and the parties submit to the exclusive jurisdiction of the English courts.

8 ENTIRE AGREEMENT
8.1 This Agreement and any Appendix (ces) on this Site embody the entire understanding and agreement between the parties in connection with the clauses of this Agreement. Notwithstanding the above, the User shall comply with all terms and conditions on the Site in relation to the Services. In the event of a conflict between this Agreement and any other terms the terms of this Agreement shall prevail.
8.2 Headings: the Clause headings in this Agreement are for reference purposes only and should not be taken into account when interpreting the clauses.
8.3 No Third Party Rights: nothing in this Agreement is intended to, nor create, any third party right whether under the Contracts (Rights of Third Parties) Act 1999 or otherwise
